1. Acceptance of Terms
By accessing or using Vitalytics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Vitalytics is a health analytics platform that aggregates data from various fitness and wellness services to provide unified dashboards, analytics, and insights. The Service includes data synchronization from third-party platforms (such as Google Fit, Oura, Hevy, Polar, and Garmin), analytics processing, and data visualization.
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it updated. You must notify us immediately of any unauthorized access to your account.
4. Premium Features (Adaptiv)
Certain features of the Service, including the Adaptiv adaptive training system, are available only to premium subscribers. Premium features include personalized workout programming, progression algorithms, and advanced coaching analytics. Premium subscription terms, pricing, and billing are presented at the time of purchase. We reserve the right to modify premium features and pricing with reasonable notice.
5. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy. You retain ownership of your health and fitness data. We process this data solely to provide the Service and as described in our Privacy Policy.
6. Third-Party Integrations
The Service connects to third-party platforms to sync your health data. These connections are made with your explicit authorization via OAuth. We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) use automated tools to scrape, crawl, or extract data from the Service without permission; (e) impersonate any person or entity.
8. Health Disclaimer
The Service provides analytics and insights based on your fitness and health data. It does not provide medical advice, diagnosis, or treatment. The training recommendations provided by the Adaptiv system are based on algorithms and historical data, not medical expertise. Always consult a qualified healthcare professional before making changes to your exercise routine. We are not liable for any injuries or health issues arising from following recommendations provided by the Service.
9. Intellectual Property
The Service, including its design, algorithms, software, documentation, and content, is owned by Vitalytics and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service. Your health data remains your property; we claim no ownership of user-submitted data.
10. Limitation of Liability
To the maximum extent permitted by law, Vitalytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim. The Service is provided "as is" without warranties of any kind, either express or implied.
11. Termination
You may terminate your account at any time through your profile settings. We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service. Upon termination, your data will be handled in accordance with our Privacy Policy and data retention practices.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal action.
